Its role is to arrange services provided by airlines, bus operators, train operators, transportation companies, hotels, tour operators and/or any other independent service providers.

INKAMAZONIA TRAVEL AGENCY – Tour Operator has no direct control over these independent companies. Therefore, in all travel arrangements, our agency acts on behalf of our clients by arranging transportation, accommodation and other requested tourism services.

Accordingly, we shall not be held liable for accidents, losses, damages, delays, inconveniences or any other irregularities caused by defects in vehicles, omissions, carelessness or negligence on the part of any company or individual contracted to provide all or part of the tourism service. This also includes circumstances resulting from vandalism, strikes, wars, government actions, weather conditions or any other factors that may result in additional expenses due to delays, itinerary changes or other causes beyond our control.

INKAMAZONIA TRAVEL AGENCY – Tour Operator reserves the right to accept or reject any passenger’s reservation request for any tour or travel package and to cancel or modify a travel package when circumstances reasonably justify such action.

A request for any service provided by our company shall be understood as the client’s acceptance of these Terms and Conditions.

INKAMAZONIA TRAVEL AGENCY – Tour Operator undertakes to inform and advise travelers regarding the conditions of their reservations and, in general, their responsibilities for the proper use of the tourism services they have contracted.

Information concerning validity periods, conditions, rates, charges, mandatory payments, preventive health measures at the destination and assistance services will be provided through our travel advisors and may also be published at our premises and on our website,

II. WHAT IT MEANS TO TRAVEL TO CUSCO AND SOUTHERN PERU

Traveling through Cusco and southern Peru requires patience, flexibility, understanding, a positive attitude and the ability to adapt to sudden changes in weather or other circumstances that may occur during your stay in the country, including force majeure situations.

III. FORCE MAJEURE EVENTS

Force majeure refers to situations or events that, despite taking all reasonable precautions, cannot be foreseen or avoided.

These events may include wars or threats of war, riots, protests, civil unrest, labor disputes, illnesses, natural disasters, adverse weather conditions, fires or any other similar event beyond our control.

By booking any of our adventure excursions, including Rainbow Mountain – Vinicunca, Humantay Lake, the Inca Trail, Salkantay, Ausangate, Choquequirao, Inca Jungle, Lares, among others, and/or any of our traditional tours, you acknowledge and assume the inherent risks associated with these types of trips.

The agency shall not be held responsible for events that may occur during the tour as a result of negligence on the part of the traveler or circumstances beyond our reasonable control.

Our travel packages are carefully designed and detailed before being approved by our clients.

Nevertheless, itineraries may be modified without prior notice due to circumstances beyond our control, including natural disasters or force majeure situations such as strikes, demonstrations, work stoppages or similar events.

We will make reasonable efforts to ensure that any modification does not compromise the safety or well-being of our passengers, in accordance with Law No. 29408, the General Tourism Law currently in force in Peru.

INKAMAZONIA TRAVEL AGENCY – Tour Operator shall not be held responsible for such events and reserves the right to modify, postpone or, when necessary, cancel a passenger’s trip. In the event of cancellation due to force majeure, the decision will be addressed with the client and supported by an appropriate explanation or report regarding the circumstances involved.

REGARDING DOCUMENTATION

INKAMAZONIA TRAVEL AGENCY – Tour Operator will reconfirm reservations by providing clients and passengers with documentation or a contract specifying the services that have been booked, thereby providing formal support for the corresponding program and services.

INKAMAZONIA TRAVEL AGENCY – Tour Operator is also registered with the competent Peruvian tax authorities and is required to issue the corresponding accounting and tax documents applicable to tourism services.

Passengers must have valid identification documents before beginning the tour. These may include a national identity document, passport and visa, when applicable.

If a traveler does not have the required valid documentation, INKAMAZONIA TRAVEL AGENCY – Tour Operator reserves the right to cancel the tour and shall not be responsible for payments previously made by the traveler.

If the situation results from negligence on the part of the traveler, the traveler will be responsible for any expenses resulting from modifications or alterations to the reservation.

Passengers must provide the personal information necessary to process their reservation, including full name, identification document or passport number, nationality, age, sex and any other information required for the booked service.

When providing personal information for a reservation, the passport or identification number must be valid and accurate. Travelers should be aware that the authorities responsible for controlling access to Peru’s main tourist attractions apply strict identification requirements.

A SUNEDU university card or an internationally recognized student card such as an ISIC card, when applicable, must also be valid. A scanned copy may be required during the reservation process, and the original card must be presented at the beginning of the tour together with the original identification document or passport used to make the reservation.

LOSS OF PERSONAL BELONGINGS

During any tour or excursion, INKAMAZONIA TRAVEL AGENCY – Tour Operator shall not be responsible for the loss, theft or damage of passengers’ personal belongings or luggage.

We strongly recommend that passengers keep their belongings under supervision at all times during excursions and tours operated or arranged by our company.

Hotels and other accommodations assigned or arranged by our company operate independently from our travel agency. Travelers are therefore advised to declare valuable items when appropriate and to keep them securely stored or supervised at all times.

VII. CANCELLATIONS, RETURNS AND REFUNDS

The following conditions apply to both individual passengers and groups.

Machu Picchu, Huayna Picchu, Machu Picchu Mountain and the Traditional Inca Trail

Once the excursion has been confirmed with payment of the 50% deposit, no refund will be issued due to the reservation requirements and restrictions involved in securing spaces for these services.

Other Traditional and Adventure Tours

If a cancellation request is received up to 90 days before the passenger’s scheduled tour start date, the refund will be subject to a penalty equivalent to 15% of the total amount paid for administrative expenses.

This penalty does not include financial expenses related to airline tickets, bank transfers, credit card commissions or any other costs associated with processing the refund.

If a cancellation request is received up to 35 days before the passenger’s tour start date, the refund will be subject to a 35% cancellation fee, in addition to financial costs related to airline tickets, bank transfers, credit card commissions and any other expenses associated with the refund.

If a cancellation request is received between 20 and 35 days before the passenger’s scheduled tour start date, a cancellation charge equivalent to 100% will apply, in addition to any financial costs associated with airline tickets, bank transfers, credit card commissions and any other expenses or costs related to the cancellation.

No refund will be provided in the event that the traveler fails to participate in the tour, misses transportation or flights due to their own delay, or voluntarily cancels the trip once it has begun.

There are no refunds for unused portions of travel packages, tours or accommodation.

If a travel package includes hotel reservations, bus tickets and/or train tickets that have already been issued or confirmed, no refund will be provided for those services where the corresponding supplier does not permit reimbursement.

Certain services may be interrupted, modified or canceled due to weather conditions, force majeure, civil disturbances or other circumstances beyond the control of hotels, airlines, suppliers or the agency itself.

No refund will be granted solely as a result of interruptions or cancellations caused by circumstances beyond our control.

During high season, the company reserves the right to modify its cancellation policies if suppliers impose different or additional penalties from those indicated above, in accordance with Article 1277 of the Peruvian Civil Code currently in force.

VIII. PICK-UP

Pick-up times will be specified in the corresponding tour program.

Passengers must be ready and waiting in the hotel lobby at the established pick-up time.

If a passenger is not ready at the scheduled time, the agency shall not be held responsible for any resulting delays or for the transportation leaving without the passenger, as the tour operates according to an established schedule.

If a passenger is intoxicated or otherwise considered unable to safely participate in the service, the agency reserves the right to cancel their participation without refund.

REGARDING HOTELS

Hotel reservations will be reconfirmed according to the accommodation arrangements established for the corresponding travel program.

When necessary, the company reserves the right to substitute a hotel with another property of the same or a similar category, with prior communication to the passenger whenever reasonably possible.

INKAMAZONIA TRAVEL AGENCY – Tour Operator is subject to hotel availability in Peru, in accordance with the applicable provisions of Article 1277 of the Peruvian Civil Code.

ADVENTURE TOURS WITHOUT CAMPING

Adventure tours frequently take place in remote areas where tourism infrastructure may be limited.

Depending on the type of excursion selected, INKAMAZONIA TRAVEL AGENCY – Tour Operator may provide between one and four nights of accommodation.

Accommodation may be basic depending on the type of program, destination and services required.

Passengers should respect the needs and schedules of other members of the expedition unless they are participating in a private tour.

Accommodation arrangements will be organized according to the program and the instructions provided by the tour guide.

REGARDING THE INCA TRAIL

The Inca Trail is classified as an adventure tourism activity and is subject to government restrictions intended to ensure its maintenance, conservation and protection.

The following conditions must therefore be taken into consideration:

Reservations will only be processed after availability has been verified for the passenger’s intended starting date.

The entrance ticket to the Inca Trail network includes access to Machu Picchu and is personal, non-transferable and valid only for the dates for which it was issued.

To use the ticket, passengers must present their passport and/or corresponding personal identification document.

Passengers receiving a student discount must also present a valid student identification card, such as the applicable ISIC card or other documentation accepted by the competent authorities.

Cancellations are accepted; however, they do not generate a monetary refund in accordance with the applicable government regulations.

Cancellations may be communicated by telephone, email or directly at the company’s office.

At the passenger’s request and where operationally and legally possible, the company may retain or provide the passenger’s entrance to Machu Picchu for the originally scheduled arrival date and the return train ticket for the date originally booked.

These conditions also apply when a traveler fails to appear at the beginning of the service.

XII. CONDITIONS DURING THE HIKE

Hikes will take place on the dates and at the times established in the itinerary.

The agency shall not be responsible for delays or changes to the program that may occur during a trek due to weather conditions, landslides, strikes, demonstrations, mobilizations or other circumstances that affect the itinerary or established schedule.

The agency will provide passengers with relevant information regarding weather conditions, approximate hiking times and altitude levels before each traditional or adventure tour, taking into consideration the passenger’s ability to continue participating during the tour.

The agency shall not be responsible for damages, accidents or illnesses arising when a passenger independently chooses to replace part of a hike with mechanical or non-mechanical transportation rented directly by the traveler.

XIII. MODIFICATIONS

The company reserves the right to modify any facilities, services or prices described on its website.

If a change is made, the client will be informed either at the time of booking or when the modification occurs.

Although the company will make reasonable efforts to operate each tour according to the published itinerary, modifications may be made whenever the company considers them necessary or appropriate due to external circumstances beyond its control.

At all times, the company will prioritize the well-being and safety of travelers, in accordance with Article 1277 of the Peruvian Civil Code currently in force.

XIV. PASSENGER RESPONSIBILITIES

The agency does not assume responsibility or liability for accidents, damages, illnesses, death or delays that may occur during the trip as a result of circumstances beyond its control.

The agency shall also not be responsible for aggressive or inappropriate behavior between passengers, force majeure events, strikes, weather conditions, earthquakes, political situations or other circumstances that may result in cancellations, modifications or delays.

Any additional expenses resulting from such circumstances shall be the responsibility of the passenger.

Likewise, the agency shall not be held responsible for missed flights, accommodation or onward travel arrangements resulting from the circumstances described above.

The agency reserves the right to cancel or modify a scheduled itinerary whenever it considers such action necessary for the proper operation of the service and/or the safety of travelers.

Passengers are responsible for carrying all appropriate and valid travel documentation, including passports, visas, travel insurance, vaccination certificates, vouchers and any other documents required for their trip.

INKAMAZONIA TRAVEL AGENCY – Tour Operator shall not be responsible for delays, losses or additional expenses resulting from incorrect, expired, incomplete or missing travel documentation.

LOCAL OR SOCIAL TRAIN TICKETS

INKAMAZONIA TRAVEL AGENCY – Tour Operator may offer promotional packages intended to encourage domestic tourism and provide Peruvian or local travelers with the opportunity to visit Machu Picchu using the Local or Social Train service.

The Local or Social Train to Machu Picchu, operated by PeruRail, is primarily available to residents of communities located around Machu Picchu. However, a limited number of seats may also be made available to Peruvian domestic travelers.

Local Train tickets may initially be sold through the corresponding offices in the city of Cusco with the passenger physically present.

If availability cannot be obtained through this method, remaining spaces in train cars assigned to local residents may become available at the corresponding stations up to approximately two hours before the train’s departure.

As a final alternative, tickets may under certain circumstances be issued manually approximately 30 minutes before departure at the station.

In such cases, a seat is not guaranteed, and the passenger may be required to travel without an assigned seat or according to the conditions established by the train operator.

The agency will make reasonable efforts to facilitate the journey of its travelers; however, these arrangements are entirely dependent on availability.

Whether passengers are able to travel at the requested time with an assigned seat or under alternative travel conditions will depend on the travel date, how far in advance the passenger arrives and the level of passenger demand on that particular day.

XVI. OUR RESPONSIBILITIES

INKAMAZONIA TRAVEL AGENCY – Tour Operator undertakes to provide the tourism services contracted by its clients and to maintain the corresponding service quality.

INKAMAZONIA TRAVEL AGENCY – Tour Operator will provide services of the agreed quality or, where circumstances require, an equivalent or higher standard, in accordance with the applicable requirements established under Article 28 of the regulations of General Tourism Law No. 29408.

Reservations are accepted after passengers have been informed of the potential risks inherent in the traditional and adventure tours included in our programs.

It is important to understand that even the most carefully planned travel arrangements may be affected by circumstances beyond our control.

The company undertakes to provide its services with reasonable care and diligence and will make every reasonable effort to ensure that the trip operates as smoothly as possible.

In response to the needs of our clients, INKAMAZONIA TRAVEL AGENCY – Tour Operator is registered with the institutions required by the Peruvian Government for tourism-sector operations.

The company also maintains the official Complaints Book required under Peruvian consumer protection regulations for the registration and investigation of incidents or complaints.

XVII. MINORS

For all programs, unless otherwise specified, travelers under the age of 18 are considered minors.

The costs of services applicable to minors, where different rates are available, will be detailed in the corresponding reservation or program documentation and may vary according to age.

When a minor travels without their parents or legal guardians, the parents or guardians must provide any notarized authorization or Power of Attorney required by Peruvian regulations authorizing another adult to travel with the minor.

The original authorization should be carried throughout the trip, and responsibility for carrying and presenting the document rests with the authorized accompanying adult.

XVIII. TRAVEL INSURANCE

Before undertaking any trip, we strongly recommend that passengers seek advice from one of our agents and, in particular, obtain comprehensive travel insurance.

The insurance should ideally provide coverage for accidents, flight delays or cancellations, medical expenses, emergency repatriation and, where appropriate, emergency air rescue or air ambulance services.

We also recommend obtaining coverage for tour cancellations and lost, delayed or damaged luggage.

Passengers may send us a scanned copy of their insurance policy by email and should also consider leaving a copy with a trusted family member or friend.

In order to ensure that these Terms and Conditions are properly understood by the contracting parties and to provide passengers with appropriate legal information during their stay in Cusco, Peru, the following Peruvian legal framework is referenced:

  • Political Constitution of Peru of 1993
  • Law No. 29408 – General Tourism Law
  • Peruvian Civil Code of 1984, as currently applicable

VERY IMPORTANT

We strongly recommend spending approximately two or three days acclimatizing at altitude before beginning a high-altitude tour.

To help reduce the likelihood of altitude-related discomfort, travelers are encouraged to remain well hydrated, eat carbohydrate-rich foods, avoid tobacco and alcohol and allow their bodies sufficient time to adjust to the altitude.

Coca tea is also traditionally consumed in the Andean region as part of the acclimatization process.

Passengers are strongly advised to inform the agency in advance of any allergies, illnesses, medical conditions, physical limitations, dietary requirements, food preferences or any other circumstances that may affect their participation in the tour.

Passengers should consult their physician regarding any medication or medical precautions that may be appropriate for their individual circumstances.

By confirming your reservation, you acknowledge that you have read, understood and fully accepted our policies, Terms and Conditions.
